1. Introduction & Definitions

  1. These Terms and Conditions ('Terms') govern the use of services provided by Let My Way Limited (company number 16335603), a company registered in England and Wales with its registered office at Eagle House, Bilton Way, Lutterworth, Leicestershire, LE17 4JA ('Let My Way', 'we', 'us', 'our').

  2. By registering an account and using our platform, you ('Landlord', 'you') agree to be bound by these Terms.

  3. Definitions: 'Services' means the advertising, referencing, and contract creation services provided via our platform. 'Listing' means the property advertisement created by a landlord. 'Tenant' means a prospective tenant introduced through the platform. 'Fees' means the charges payable by landlords for the Services. The scope of these Terms is limited to England at launch.
     

2. Services Provided

  1. Let My Way provides the following services:

    1. Advertising platform for rental listings (platform only).

    2. Tenant referencing services (introducing agent role).

    3. Contract creation and e-signing of tenancy agreements (introducing agent role).

  2. We do not provide deposit handling, rent collection, or ongoing property management services.
     

3. Account Registration & Eligibility

  1. To use the Services, you must be the legal owner or authorised landlord of the property to be advertised.

  2. We may request proof of ownership or authority at our discretion.

  3. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
     

4. Landlord Obligations & Warranties

  1. Compliance Warranties
    You warrant that, at all relevant times, you have complied with all legal requirements for the letting, including but not limited to: obtaining and maintaining valid EPC, Gas Safety Record, EICR, applicable licensing (e.g., HMO), functional smoke and carbon monoxide alarms, adherence to deposit caps under the Tenant Fees Act 2019, and relevant tenancy legislation.

  2. Accuracy of Listings & Representations

    1. You must provide up-to-date photos of the Property.

    2.  You must describe the Property in the best and most accurate way — being honest about condition, fixtures, fittings, and surroundings.

    3. You must not provide any misleading or out-of-date information.

  3. Accuracy of Provided Data
    You are solely responsible for ensuring all information you provide to Let My Way — including property details, personal data, bank account details, and contact details — is complete, accurate, and up to date. Let My Way disclaims all liability for any errors in that information, including any loss or dispute arising from transmission of incorrect data.

  4. Right to Rent & Sanctions Checks
    You remain fully responsible for conducting any checks required under the Right to Rent regime (Immigration Act 2014) and any applicable sanctions or background checks.

  5. Third-Party Permissions
    If required (e.g. by mortgage lender or superior landlord), you must obtain all necessary permissions before listing the Property. Let My Way is not liable for listings or contracts entered into without such third‑party consent.

  6. Indemnity
    You agree to indemnify Let My Way against all claims, losses, liabilities, or expenses arising from: (i) a breach of these warranties or obligations, (ii) any inaccurate or outdated information provided, (iii) failure to complete required legal checks, or (iv) listing without required permissions.
     

5. Fees & Payment Terms

  1. All Services are subject to an upfront fee, payable via Stripe at the point of order.

  2. No refunds are available once the Service has commenced, which occurs instantly upon purchase.

  3. Listings automatically expire three (3) months after the upload date.

  4. All Fees are exclusive of VAT unless stated otherwise.
     

6. Listings & Content

  1. You are responsible for the content of your Listings, which must comply with applicable law and not be discriminatory or misleading.

  2. By uploading content, you grant Let My Way a perpetual, royalty-free licence to use, reproduce, and distribute such content for the purpose of providing the Services and marketing activities.

  3. We reserve the right to edit, suspend, or remove any Listing at our discretion, including in cases of breach of these Terms or our advertising partners' requirements. No refunds will be given in such cases.
     

7. Referencing & Contract Creation

  1. Tenant referencing is provided as an introducing agent service. Final acceptance of a tenant remains your responsibility.

  2. All referencing and contract negotiations are subject to contract until the tenancy agreement has been executed by both parties.

  3. Tenancy agreements are provided using Agent Vision templates, supplied on an 'as-is' basis and do not constitute legal advice.
     

8. Deposits & Holding Deposits

  1. We do not accept or handle holding deposits or tenancy deposits on behalf of landlords.

  2. Where tenants are required to pay a holding deposit, landlords must provide their own bank details and ensure compliance with the Tenant Fees Act 2019.

  3. Registration and protection of tenancy deposits remain solely the landlord’s responsibility.
     

9. Client Money

  1. Let My Way does not hold or handle client money at any time.

  2. Payments for Services are processed via Stripe, whose terms and conditions apply in addition to these Terms.
     

10. Data Protection & Privacy

  1. We act as a data controller in relation to personal data collected on the platform. Once tenant data is shared with landlords, those landlords act as independent controllers and assume all GDPR responsibilities for their use of that data.

  2. Where we share personal data with third-party providers (e.g. referencing agencies), a Data Processing Addendum shall apply.

  3. We may share limited data with selected partners on a legitimate interest basis to facilitate tenancy-related services. You may opt out of such sharing at any time.
     

11. Suspension & Termination

  1. We may suspend or remove Listings, or terminate your account, immediately in the event of any breach of these Terms, including breaches of the Landlord Obligations & Warranties set out in Section 4. No refunds will be provided in such cases.

  2. Without limitation, suspension or termination may occur where: (a) information provided by you is found to be false, misleading, or out of date; (b) you fail to meet statutory requirements (including EPC, GSR, EICR, licensing, or Right to Rent checks); (c) you fail to obtain necessary third-party permissions to let the Property; or (d) your conduct, or that of your Listing, breaches applicable law or the standards of our advertising partners.

  3. Suspension or termination shall be considered on a case-by-case basis, and Let My Way reserves the right, in its sole discretion, to reinstate access to the Services where breaches have been remedied to our satisfaction.

  4. Inactive accounts may be left dormant but not automatically cancelled.

  5. You may terminate your account at any time by providing written notice to us.
     

12. Liability & Indemnity

  1. Our total liability to you for any claim arising under these Terms shall be limited to the total Fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

  2. We shall not be liable for indirect, consequential, or special losses, including loss of profit, business, or data.

  3. Nothing in these Terms shall limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under law.

  4. You agree to indemnify us against all claims, damages, or costs arising from your breach of these Terms or any applicable law.
     

13. Complaints & Redress

  1. We operate an internal complaints procedure which can be initiated by contacting us in writing.

  2. As a member of The Property Ombudsman (TPO), you may escalate complaints to the TPO if you are not satisfied with our response.

  3. We will acknowledge complaints within 3 working days and aim to provide a final response within 15 working days.
     

14. General Terms

  1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.

  2. The courts of England shall have exclusive jurisdiction over any disputes arising out of these Terms.

  3. We shall not be liable for failure to perform our obligations where such failure results from events beyond our reasonable control (force majeure).

  4. We may amend these Terms from time to time by posting updated versions on our website.

  5. If any provision of these Terms is found invalid, the remaining provisions shall remain in full force and effect.
